The widow of Anthony Barnes, a 48-year-old British man who tragically lost his life in a spa fire while staying at the Jaal Ryad Resort Hotel in Marrakech, Morocco, is pursuing legal action against the hotel chain for over £500,000. Mr. Barnes, who was on a business trip when the incident occurred in March 2023, succumbed to the fire's effects while receiving a massage treatment. The unfortunate event also claimed the life of a hotel staff member.

In her lawsuit, Rachel Barnes alleges that the fire was a direct result of the hotel’s negligence, claiming that the management failed to uphold necessary safety standards that would have prevented her husband's death. According to court documents, the hotel, operated by Hotel Des Idrissides, has denied any wrongdoing, asserting that Mr. Barnes’ death was not caused by negligence or a breach of duty on their part.

Details of the Incident and Allegations

During the court proceedings, Mrs. Barnes’ barrister, Matthew Chapman KC, emphasized that the inquest conducted in the UK had determined the death to be accidental, citing the presence of thick, acrid smoke that severely impaired visibility and hindered rescue efforts. The legal team argues that the hotel’s mismanagement of its spa facilities exposed Mr. Barnes to foreseeable risks, including inadequate fire alarms and emergency lighting, failure to alert him about the fire, and an absence of operational CCTV cameras that could have assisted in the evacuation process.

Moreover, Chapman highlighted that the materials used in the spa’s construction were not adequately fire-resistant, and the number of fire extinguishers available was insufficient. According to him, such failures indicate a lack of proper design, installation, and maintenance of the spa facilities, which typically prevent accidents of this nature.

In defense, Alistair Mackenzie, representing Hotel Des Idrissides, contended that the fire originated in the sauna and that hotel employees acted promptly to raise the alarm and assist in evacuating guests, including Mr. Barnes. He stated that the hotel complied with Moroccan regulations for safety and that while smoke alarms were not installed in Mr. Barnes' treatment room due to humidity concerns, they were present in adjacent areas.

This tragic incident has raised significant concerns regarding the safety protocols in place at hotels and resorts, particularly those catering to international guests. As the case unfolds, it will likely bring to light important discussions about guest safety and hotel responsibility in emergency situations.
