The current electoral landscape in Morocco invites reflection on the historical legal struggles that have shaped the nation’s parliamentary elections. Since the adoption of the Constitution in 1962, the political and legal arenas have often intersected, leading to numerous electoral disputes that have highlighted the complexities of governance in the country. In this examination, we revisit significant moments from the archives of electoral challenges, spotlighting prominent political figures who played crucial roles in these contests. One such episode involves Abdessamad Belkabir and his adversaries, including Abdellah Rafouch, during the parliamentary elections of September 7, 2007.
Abdessamad Belkabir engaged in a fierce electoral and judicial battle in the "Gueliz - Nakheel" district of Marrakech, culminating in the annulment of the election of one of his opponents, Abdellah Rafouch. This decision was rendered by the Constitutional Council under ruling number 08/704 M.D., issued on May 28, 2008. The election results initially indicated the selection of Rafouch, Rachid Ben Driouch, and Ismail Barhoumi as members of the House of Representatives. However, shortly after the results were declared, Abdel Salam Si Kouri filed a challenge against Rafouch, while Belkabir contested the validity of the election results against all declared candidates.
Belkabir's petition presented a plethora of striking allegations and incidents. He claimed that just an hour before the polls closed, he was verbally assaulted and had his campaign materials destroyed by women, reportedly over a local radio station. Additionally, he alleged that he received threats involving a knife in the Harbil community. The challenge also mentioned that three representatives from Belkabir's list suffered from food poisoning, allegedly after consuming a meal provided by local authorities, alongside claims of monetary distributions, spreading rumors, and power outages during the vote counting at the central office in the Oasis of Sidi Ibrahim.
However, the Constitutional Council did not find sufficient evidence to support these claims as a basis for annulling the election results, noting that two complaints filed with the prosecutor regarding certain incidents were ultimately closed without further action. Nonetheless, the trajectory of the challenge took a different turn concerning Abdellah Rafouch. The Council relied on police reports and other judicial data, concluding that there were indeed practices aimed at swaying voters and coercing them to vote for Rafouch, who was then serving as the head of the Nakheel district, utilizing some local authority aides in the process.
The ruling outlined that two local authority aides were convicted by the Marrakech court, which the Council deemed as crucial evidence that these practices had a tangible impact on the integrity of the electoral process. Ultimately, while Belkabir's request to annul the elections of Rachid Ben Driouch and Ismail Barhoumi was denied, the Council did invalidate the election of Abdellah Rafouch as a member of the House of Representatives, ordering a re-election for the seat he had occupied.
