The Primary Court of Marrakech has announced an exceptional measure aimed at reducing misdemeanor fines for those convicted. This initiative is part of the efforts by the Ministry of Justice to facilitate the collection of public debts, ensuring a more efficient judicial process.
The legal basis for this measure is derived from Article 634-1 of the Criminal Procedure Code, which allows convicted individuals to benefit from a reduction of up to two-thirds of the fine amount, provided they adhere to specific legal conditions. According to the announcement, eligibility for this privilege is contingent upon the payment of the fine within a maximum period of 30 days. This period is calculated from the date of the pronouncement of the sentence in cases where the accused was present, or from the date of notification for sentences delivered in absentia or considered as such.
However, the decision excludes certain categories of public debts from this reduction. Specifically, it does not apply to confiscated funds, compensations owed to the public treasury or third parties, fine refunds, court costs, and contributions to the guarantee fund. The primary aim of this measure is to encourage convicted individuals to voluntarily settle their obligations within the legal deadlines, while also striving to expedite the enforcement of judicial decisions and alleviate the burden of collection procedures.
This announcement, signed by the head of the registry at the Primary Court of Marrakech, has been disseminated to stakeholders and professionals to ensure proper awareness and compliance with the new provisions.
