The medical team hastily diagnosed her with “acute cholecystitis,” concluding that she required immediate surgery for gallbladder removal. However, the patient expressed doubts about the accuracy of this swift diagnosis and opted to transfer to another healthcare institution for further evaluation.
At the new facility, comprehensive laboratory tests and thorough examinations revealed an unexpected diagnosis: she was suffering from “falciparum malaria,” a severe tropical disease that necessitates a precise treatment protocol. This alarming discovery led to her urgent transfer to the intensive care unit to save her life.
The judicial medical expertise involved in the case unequivocally confirmed that the initial clinic demonstrated a lack of diligence. The clinic failed to follow proper initial examination protocols and did not inquire about the patient’s medical history or recent travels abroad, which the court deemed a breach of professional duty. This negligence was identified as a direct cause of the health complications that resulted in the victim sustaining permanent disability, significantly impacting her personal and professional life.
Despite the clinic’s legal team arguing for the validity of their medical protocols and attempting to assert that differing diagnoses can occur in medical practice without implicating liability, the court ruled against them.
