Official Resolution of Property Dispute in Marrakech

The longstanding real estate dispute in Marrakech has reached an official settlement following a reconciliation session held on March 19, 2026, in the presence of the public prosecutor at the local court. This initiative culminated in a final agreement signed on March 23, effectively putting an end to the conflict between Caprice Immobilier and several affected parties, while clearly defining the obligations of both sides.

According to the stipulations of the agreement, the legal representative of Caprice Immobilier has committed to permanently abandoning the construction of the fourth and fifth floors of the project. This decision aims to rectify the legal status of the building and ensure compliance with the existing urban planning regulations. Furthermore, the agreement mandates the resumption and completion of construction within a maximum period of three months from the date of signing. To address the grievances of those affected by the unlicensed upper floors, the company will provide alternative apartments on the first, second, and third floors.

Regarding the delivery timeline, the company has pledged to hand over the apartments to the beneficiaries within one year at the latest, ensuring all administrative procedures are completed, including obtaining the necessary legal permits and ownership certificates for each residential unit. To secure the execution of these commitments, the agreement includes a clause imposing a penalty for delays in the delivery timeline, whereby the company will be required to pay a monthly compensation to the affected parties amounting to one percent of the total value of each apartment for every month of delay.

Several affected individuals expressed their satisfaction upon receiving official documents confirming their rights to the disputed apartments. They view this development as a significant turning point in resolving a prolonged issue. Additionally, members of the Moroccan community involved commended the role played by the public prosecutor at the Marrakech court, alongside the president of the local bar association and lawyer Shorouk Zardawi, praising their efforts in expediting the case's resolution in a timely manner.

This settlement follows a previous insistence from the public prosecution on the need to accelerate construction works and initiate immediate preparations for the project, with the construction site now subject to regular oversight by the judicial police, particularly after a complete halt in operations contrary to earlier statements made by the real estate developer.
