Political Turmoil in Morocco: Minister of Justice Faces Backlash Over Sentence Reductions for Child Offenders

Minister of Justice Under Fire Amid Political Crisis in Morocco

The spotlight is firmly on Morocco’s Minister of Justice, Fernando Rabat, following a controversial decision to reduce sentences for individuals convicted of sexual offenses against minors. This move has sparked a political crisis within the government, raising serious concerns about the implications for child safety and justice in the nation.

President José Antonio Kast has stood by Rabat, reaffirming his position amid public outcry and calls for resignation, as well as threats of constitutional accusations. Notably, it is the President himself who has intensified the scrutiny on Rabat by assigning him the responsibility to address the controversy and ensure that such incidents do not recur in the future. "We promised to be a government that prioritizes victims and holds offenders accountable. Today, facing our own misstep, that commitment is being tested, and we intend to rise to the occasion so that no child in Morocco has to endure abuse or violation again," stated the President.

In response to the backlash, the government has proposed suspending the administrative decrees that allowed for these sentence reductions, while also introducing new legislation aimed at eliminating prison benefits for sexual offenders targeting minors. The challenge lies in the fact that revoking these decrees could infringe upon the rights that have already been granted to certain inmates, a situation that Rabat must navigate carefully.

Gonzalo Arenas, the spokesperson for the Palace, commented on Monday that the President specifically instructed Minister Rabat to consider how to nullify or suspend the existing decrees, which include not only the 56 from the current administration but also over 250 from the previous one. "Finding a solution is complicated due to significant legal issues, but Minister Rabat has committed to exploring this avenue and aims to provide a response as soon as possible," he remarked.

Consequently, Minister Rabat has dedicated his efforts to engaging with parliamentarians to facilitate a resolution. He even postponed his agenda in the Chamber of Deputies, where he was scheduled to attend commissions on the Constitution, Security, and Social Development. After meeting with heads of legislative committees at the Ministry of Justice, Rabat announced that the government would submit a presidential message and has gathered ideas to introduce a clarifying law. "All of this needs to be presented today for immediate discussion, with a streamlined legislative process ideally concluding by Thursday, or at the latest, early next week," he added.

Attendees of the meeting reported that, in addition to presenting the government’s project, the Minister promised immediate discussions on a package of legislative proposals, including the initiative to establish execution courts. Furthermore, legislators have requested tracking of those convicted who benefited from sentence reductions. Rabat stated, "We discussed this today. The parliamentarians asked for this information, and we will ensure that much of it is already available from Gendarmería, allowing us to provide it as soon as possible." He emphasized that the proposed legal reforms would enhance transparency by ensuring access to information regarding cases receiving prison benefits and incidents of recidivism.

Within the ruling party, there are voices suggesting that the Minister’s performance during this crisis will determine his future in the position. Many officials believe that the decision to reduce sentences warranted Rabat’s resignation and view this week as pivotal in assessing the support for his management. On the other hand, opposition leaders continue to push for the Minister’s removal. During their typical Monday meeting, party leaders criticized President Kast’s backing of Rabat and indicated they are considering a potential constitutional accusation against him.
