Court Ruling Reinstates Registration Fees for Doctorate Students

The Administrative Court of Appeal in Fes has annulled an initial ruling from the administrative court of Oujda, which had suspended the decision made by the council of Mohamed First University in Oujda regarding the imposition of registration fees for final enrollment in the doctoral program. This decision is pivotal as it reinstates the university's authority to charge fees that had been contested by some students.

According to the appellate court's ruling, the appeal was accepted procedurally, and the prior judgment was overturned, leading to the rejection of the request to halt the execution of the administrative decision. The court found that the conditions necessary to grant requests for suspension of execution were not met in this case. This decision comes after a challenge to the initial ruling, which had temporarily halted the university's fee collection until the annulment case could be resolved.

Upon reviewing the documents and evidence presented, the appellate court concluded that the legal elements of seriousness and urgency, which must be satisfied for such requests, were lacking. The court emphasized that the contested decision does not possess an urgency that would justify immediate suspension, particularly given that any legal effects could be remedied post-judgment in case of annulment, thus negating the need for urgency.

This ruling is expected to rekindle discussions regarding the legitimacy of imposing fees on doctoral students and the extent of universities' authority in regulating access and registration, particularly in light of constitutional principles related to the right to education and its accessibility, as well as the principle of equality among students.
