CNI's Decision to Dismiss Agent Raises Security Concerns
The National Intelligence Center (CNI) of Spain has made headlines following its decision to terminate an agent of Moroccan descent due to apprehensions regarding his loyalty to the country and its intelligence operations. This move, authorized by the National Court, stems from a report indicating that the agent's allegiance was deemed "uncertain," raising red flags about the potential risks he posed to national security. The internal assessment, carried out by the CNI’s Personnel Division, highlighted fears that the agent could be susceptible to recruitment by Moroccan intelligence, which could compromise sensitive information and operations within the agency.
The internal report, dated August 22, 2023, reveals that the findings are critical to the safety of both the CNI and its personnel. It outlines the agent's negative attitude towards his responsibilities, suggesting that he consistently failed to adhere to internal regulations and confidentiality obligations. The report states that his behavior indicated a lack of respect for the institution and those within it, including his partner, who also serves as an agent in the secret service. Such factors, combined with the agent's dissatisfaction and ties to Morocco, were considered serious security threats, as they could potentially be exploited by Moroccan intelligence operatives.
Following the report's release, CNI Director Esperanza Casteleiro informed the agent of his termination, citing that he was no longer fit to serve within the agency. This decision came in the wake of heightened tensions between Spain and Morocco, particularly during a diplomatic crisis involving the hosting of a leader from the Polisario Front. During this period, the CNI had warned the Spanish government about Morocco's efforts to recruit informants within Spain, emphasizing that considerable resources were being allocated for these espionage operations.
Legal Appeals and Ongoing Controversies Surrounding Dismissal
The former agent has since appealed his dismissal, arguing that it was a result of discrimination based on his Moroccan heritage rather than any legitimate concerns regarding his performance. He contends that prior to his termination, he successfully completed a training course for a CNI mission in Syrian Kurdistan, where he was deemed mentally fit to participate, although he ultimately did not deploy. Furthermore, he has presented evidence, including WhatsApp messages and testimonies from his partner, alleging mistreatment and bias within the agency.
Despite his efforts to challenge the dismissal, the courts have consistently ruled against him. The initial rejection came from the CNI in November 2023, followed by a dismissal from the Contentious-Administrative Court No. 10 of the National Court in December 2024, which affirmed that the CNI's actions were lawful. The latest setback occurred on March 4 of this year when the Fifth Chamber of the Contentious-Administrative Division echoed earlier judgments, reiterating that the agent's alleged disloyalty posed a threat to national security. Although the former agent has the option to appeal to the Supreme Court, the likelihood of a reversal remains uncertain.
