Legal Implications of Migration Control in Europe
In a recent interview on "ZiB 2" with host Armin Wolf, European law professor Daniel Thym discussed the pressing issue of migration control, particularly in relation to Morocco's role in restricting access to the Spanish enclave of Ceuta. Thym emphasized the critical nature of whether Morocco is actively preventing individuals from reaching the beach, a factor that could significantly influence the legal landscape surrounding migration rights and responsibilities. He noted that while the establishment of asylum centers may be easily declared in Brussels, the practical implementation of these centers presents far greater challenges.
The discussion follows a tragic event where dozens lost their lives in attempts to reach Ceuta, highlighted by the overwhelming surge of 72,000 individuals from Morocco. Thym pointed out that the reactions from various EU member states have been far from ideal, stating, "No one has delivered a truly commendable response – neither Morocco, nor Spain, nor the other EU countries." He expressed cautious optimism for the upcoming meeting of EU interior ministers, hoping it would lead to a more unified and constructive approach to managing this complex issue. However, he also indicated that achieving consensus and cooperation among member states is likely to be a difficult task.
