Moroccan Court Introduces Major Fine Reductions
The Marrakech First Instance Court has recently announced an extraordinary measure aimed at reducing minor offense fines for those convicted. This initiative aligns with the directives from the Ministry of Justice, which seeks to facilitate the collection of public debts. According to the provisions of Article 634-1 of the Criminal Procedure Code, individuals may benefit from a reduction of up to two-thirds of the fine, provided they meet specific legal requirements.
To qualify for this privilege, individuals must pay their fines within a maximum of 30 days from the date of the court's decision in cases that were attended or from the date of notification for absent judgments or those treated as attended. However, this measure excludes several types of debts, including funds ordered for confiscation, compensation to the public treasury or affected parties, in addition to refunds of fines and litigation costs, as well as contributions to the guarantee fund.
The primary aim of this decision is to encourage those involved to voluntarily settle their situations within the legal deadlines, while also expediting the enforcement of court rulings and alleviating the pressure associated with collection procedures. This announcement, signed by the Chief Clerk of the Marrakech First Instance Court, has been disseminated among various stakeholders and professionals to ensure awareness and compliance with its stipulations.
