Morocco Advances Legislative Bill on Constitutional Challenges

Moroccan Committee Approves Bill for Constitutional Law Challenges

In a significant move towards enhancing judicial processes in Morocco, the Justice, Legislation, and Human Rights Committee of the House of Councillors has officially approved Organic Bill No. 35.24. This legislation outlines the specific conditions and procedures that will govern the process of challenging the constitutionality of laws within the country. The committee's decision was reached during a session attended by Justice Minister Abdellatif Ouahbi, where the bill received a majority vote—five votes in favor, one against, and two abstentions. This approval marks a pivotal step in strengthening judicial oversight and ensuring that legislative acts align with the constitutional framework.

During the deliberation, the government showed its willingness to engage with the committee by accepting three amendments proposed by both the majority groups and the Haraki group. These amendments were incorporated into the consensus version of the bill that was ultimately adopted. Notably, the first amendment pertains to the title of Chapter III, which specifically addresses the conditions and procedures required for raising a constitutional challenge before the Constitutional Court. Such reforms are expected to facilitate a more transparent and accountable legal process in Morocco, reinforcing the rule of law and the rights of individuals to contest legislative decisions.
