Spanish prosecutors are actively seeking to bring two Moroccan nationals to trial over serious allegations concerning the illegal shipment of nearly 1,800 tons of textile waste from Morocco to southern Spain, specifically through the Port of Algeciras. This case has been characterized by the prosecutors as one of the most significant illegal waste-trafficking operations ever identified in the region, involving a total of 85 separate shipments of discarded clothing and textile remnants sent to Spain between late 2022 and mid-2023.

Legal Ramifications and Environmental Implications

According to the prosecutors based in Algeciras, the accused individuals utilized two different companies to transport approximately 1,801 tons of textile waste from Morocco, subsequently storing this material in industrial warehouses located in San Roque, a town near the Strait of Gibraltar. It has been alleged that neither the companies involved nor the storage facilities possessed the necessary environmental permits mandated by Spanish law. Investigators indicated that the textile waste was introduced into Spain via the Port of Algeciras and was kept in warehouses that were not authorized to handle such hazardous materials. Furthermore, the companies in question were not registered within Andalusia’s waste management system, which raises further legal concerns.

The prosecution asserts that the defendants neglected to provide essential documentation required for cross-border shipments of textile waste, a violation of European regulations as well as international agreements linked to the Basel Convention, which seeks to regulate the transboundary movements of hazardous waste. One of the accused is reported to have acted as the sole administrator of both companies implicated in the operation, while the other held a senior managerial position at one of the firms. Spanish authorities are advocating for prison sentences of 18 months for each of the individuals involved, in addition to temporary bans from working within the waste management sector.

Moreover, both companies face potential fines and restrictions on their future business activities related to waste handling. The investigation was initiated following the discovery of significant amounts of textile waste stored illegally in a warehouse in San Roque by environmental inspectors. The inquiry was subsequently expanded by Spain’s environmental enforcement unit, SEPRONA, leading to the formal charges being filed by prosecutors. Investigators suspect that certain operators may be attempting to evade the costs associated with the legal disposal of industrial textile scraps by exporting them abroad, where reusable items can be sold while the remaining waste is improperly stored or discarded, posing significant environmental risks.
