Strengthening the Protection of Waqf Properties
The Moroccan Ministry of Endowments and Islamic Affairs has committed to a comprehensive strategy aimed at safeguarding waqf properties through a systematic approach to land registration. This initiative involves submitting registration requests for waqf properties, accompanied by detailed site plans and technical files, particularly for larger parcels of land. The Ministry has outlined a clear process in a strategic partnership agreement designed to enhance the registration of waqf properties throughout Morocco. In adherence to this agreement, the Ministry will submit these requests categorized geographically to expedite the identification process, with predefined programs established through mutual agreement between the involved parties.
Key Provisions of the Strategic Agreement
The strategic partnership was formalized by Ahmed Toufiq, the Minister of Endowments and Islamic Affairs, and Karim Tajmouati, the Director General of the National Agency for Land Conservation, Cadastre, and Mapping. The agreement stipulates the presence of a waqf representative during land identification operations, ensuring that all necessary means for these tasks are prepared. This representative will assist the appointed surveyor in accurately defining the property boundaries, thus facilitating the identification process. Furthermore, the Ministry is committed to engaging with administrative and judicial authorities to gather requisite documents to complete the registration process and will promptly respond to inquiries from land registration offices regarding waqf properties.
In return, the National Agency is responsible for conducting preliminary location assessments for waqf properties that have site plans prepared by the Ministry. Additionally, the agency will oversee the technical files for these properties, ensuring they are approved within a maximum of 15 days upon submission. The agency is also tasked with expediting the study and processing of registration requests, adhering to established timelines.
The Ministry has pledged to submit requests for updating the land registration documents of waqf properties, including all necessary technical files and permits, while ensuring compliance with legal requirements. The agency, on its part, will process these requests within reasonable timeframes and will inform the Ministry of any obstacles that prevent the registration of these documents.
This partnership not only aims to streamline the registration of waqf properties but also emphasizes the importance of legal protection mechanisms and the preservation of professional confidentiality. Both parties have agreed to enhance digital services and foster communication and coordination to ensure the successful implementation of this agreement. Moreover, they will engage in the creation of special agreements as necessary to address emerging challenges in the realm of digital services related to waqf property registration.
