Serious Allegations of Fraud and Conspiracy in Meknes

In a significant development that has exposed a complex web of forgery involving official documents, false testimony, and participation in organized marital infidelity, Ms. Ayada Boumlsa, holding national ID number 22616 D and residing in Tower Tolaal 218, Meknes, has filed a direct complaint with the Public Prosecutor at the Court of First Instance in Fes. She demands an urgent investigation into the circumstances surrounding the formation of a criminal conspiracy, the forgery of official documents, and their use, as well as false testimony and involvement in organized marital infidelity. The complainant has submitted a series of documents substantiating her case, which the newspaper possesses copies of.

The complaint indicates that Ms. Ayada Boumlsa has been married to the first accused, Jalloul Ben Moussa Jalloul (her husband), since July 22, 1968, and they have four children together. Their marriage remains legally and religiously valid. However, the summer of 2013 marked a dramatic upheaval in the family's life when Ms. Boumlsa, along with her children and grandchildren, was expelled from their marital home located in the Ait Hamo Arhou neighborhood of the Majat community in Meknes. During this time, her husband brought in another woman, referred to as A.K., under the pretense that she was a 'servant' with a work contract, which the complaint asserts was essentially a façade.

Documented Evidence of Marital Fraud

The complaint further alleges that the four accused entered into an invalid marriage contract dated January 14, 2019, under ruling number 434, based on forged documents. It asserts that the second wife, A.K., was fully aware that the man was married, supported by conclusive evidence, including previous complaints lodged against both parties for involvement in marital infidelity and corrupt practices.

Najia Ben Moussa, the daughter of Ms. Ayada Boumlsa, claims ownership of the upper floor of the disputed house based on a legal deed (purchased from her father), but has been barred from entering it by her father's second wife since 2013. She filed a complaint in 2018 before the invalid contract was established.

The complaint highlights a constitutional violation in the previous judicial proceedings: the Court of First Instance in Fes acquitted the husband and his accomplices in a ruling deemed erroneous by the complaint. The ruling was appealed to the Court of Appeals in Meknes in 2020, and after more than two years of waiting, a decision was issued without Ms. Boumlsa or her lawyer being notified of any hearings or the content of the ruling.

This violation contradicts Article 302 and subsequent provisions of the Criminal Procedure Law and infringes upon the constitutional right to defense. A lawyer submitted a complaint to the Attorney General at the Supreme Court of Justice in Rabat in 2024, but no response has been received to date.

According to the complaint, the actions described constitute a violation, with the second wife (A.K.) being fully aware of her husband's existing marriage.

In terms of legal demands, the complainant requests the consolidation of the file, a thorough investigation, and a field inspection. The complaint presents four main requests to the Public Prosecutor in Fes:

  • To merge file number 1841/3101/2023 (a prior complaint regarding forgery) with this complaint due to the unity of parties and subject matter.
  • To instruct the judicial police to conduct a comprehensive preliminary investigation against the four accused and to investigate the civil servant who issued the forged residency certificate.
  • To conduct a field inspection of the real husband's residence in Majat to prove the falsehood of his claimed residence in Fes.
  • To prosecute all involved according to the law and refer them to the investigating judge.

Ms. Ayada Boumlsa reserves her full rights to act as a civil party in this case. In conclusion, she appeals for justice in Fes after experiencing a lack of fairness in Meknes, firmly believing in the sanctity of seeking the justice of the Public Prosecutor in Fes, and requesting intervention to remedy the injustice and harm she has endured following the absence of recourse in previous proceedings.
