Justice Minister Fernando Rabat Defends Decisions on Early Releases
In a significant Senate Constitution Committee meeting that took place on Tuesday, Justice Minister Fernando Rabat faced inquiries regarding the alleged benefits granted to three Venezuelan citizens claiming ties to the notorious Tren de Aragua gang. The session was primarily focused on discussing various legislative projects aimed at preventing convicted sex offenders from accessing penitentiary benefits.
During the meeting, Senator Daniella Cicardini from the Socialist Party raised concerns about a report published by Interferencia, which revealed that reductions in sentences had been granted to a group of extortionists, who purportedly claimed affiliation with the Tren de Aragua gang. According to the aforementioned report, the Ministry of Justice had signed three decrees that provided penitentiary benefits to three out of four members of this Venezuelan extortionist group, leading to the release of two individuals following the execution of their reduced sentences.
In response to Senator Cicardini's pointed question about whether he was aware that the reductions in sentences he signed involved individuals associated with a suspected criminal gang, Rabat emphasized the importance of understanding the legislative process. He explained that the analysis of such cases is conducted by the respective commission, and that the Ministry of Justice's role is clearly defined within the legal framework, specifically citing Article 17 of Law 19.856. Rabat insisted that the procedures followed were in accordance with established legal norms, asserting that the Executive branch cannot unilaterally alter these regulations without proper authority.
As the discussion unfolded, Minister Rabat reiterated that there might be a misunderstanding regarding the application of Article 17, which has been in place since 2003 and outlines the grounds for exclusions from benefits. His statements aimed to clarify the procedural safeguards in place, as well as the limitations of the Executive's powers in these matters.
